Gnuf is a company incorporated in Malta (C39710), and subject to Maltese law. Gnuf is licensed and regulated by the Malta Lotteries and Gaming Authority, license number LGA/CL3/302/2006. Be sure to always keep yourself updated on the Terms and Conditions below.
These Terms and Conditions (“T&Cs”) apply to, and are binding upon you if you participate in any of the Games available at www.Gnuf.net
1.1. In these T&Cs:
1.1.1. “Game/s” means any Game or Games which You are permitted to play on the Websites.
1.1.2. “Free Play Account” means a unique Account that has been issued by Gnuf to You.
1.1.3. “Website/s” means www.Gnuf.net or any derivative thereof and all content therein.
1.1.4. “We/Us/Our/The Company/Gnuf” means Gnuf Limited, the owners and operators of the Websites and the related enabling internet, mobile or other platforms.
1.1.5. “You/Player/s” mean individuals who accept these T&Cs.
1.2. These T&Cs constitute a binding agreement between You and Gnuf.
1.3. Gnuf is a limited liability company incorporated in Malta, and subject to Maltese law, having its registered address at Suite A, Dolphin Court A, Embassy Way, Ta’ Xbiex MSD 11, Malta.
1.4. Gnuf is licensed and regulated in Malta by the Malta’s Lotteries and Gaming Authority, licence number LGA/CL3/302/2006.
1.5. These T&Cs come into force as soon as you click on the “ACCEPT” button, by doing which you signify to Gnuf that you have read these T&Cs and accept them. By using any of the Websites you signify that you agree with these T&Cs.
1.6. You must read these T&Cs carefully in their entirety before clicking on the “ACCEPT” button. If you do not agree with any provision of these T&Cs you must not use or continue to use the Websites.
1.7. Gnuf reserves the right to amend these T&Cs at any time without giving notice. Your continued use of the Website following such amendment shall constitute your acceptance of any such amendment.
1.8. Rules and explanations for playing Games on the Websites are incorporated into these T&Cs by reference.
1.9. These T&Cs may be published in a number of languages for information purposes and ease of access by players. It is only the English version that is the legal basis of the relationship between You and Gnuf and in case of any discrepancy between a non-English version and the English version of these T&Cs, the English version shall prevail.
2.1. You may participate in any of the Games if and only if:
2.1.1. You are over eighteen (18) yeas of age or such higher minimum legal age of majority as stipulated if the jurisdiction of Your residence; and
2.1.2. it is legal for You to participate in the Games according to applicable laws in the jurisdiction of your residence.
2.2. It is entirely and solely Your responsibility to enquire and ensure that You do not breach laws applicable to you by participating in the Games.
3.1. Registration and opening of your Free Play Account
3.1.1. In order for you to be able to play Games at any of the Websites, you must first register with Gnuf and open a free play account (“Free Play Account”).
3.1.2. You are allowed to have only one Free Play Account.
3.1.3. All mandatory information requested by Us must be submitted via Your registration form. You hereby warrant that the details submitted by you are true, complete and correct. You are hereby notified that We carry out verification procedures and Your Free Play Account may be blocked or closed if You are found to supply false or misleading information.
3.1.4. If You notice that You have more than one Free Play Account under different names, you must notify Us immediately.
3.1.5. As part of the registration process You will have to choose Your username and password for Your login into the Websites. It is Your sole and exclusive responsibility to ensure that Your login details are kept securely. You must not disclose Your login details to anyone. Gnuf is not responsible for any abuse or misuse of Your Free Play Account by third parties due to Your disclosure, whether intentional or accidental, whether active or passive, of your login details to any third party.
3.2. Dormant Free Play Accounts
3.2.1. A Dormant Account shall mean a Free Play Account that has been inactive for a period of 6 (six) months or more (“Dormant Account”). Where a Free Play Account becomes a Dormant Account We shall close Your Free Play Account. You will however, subject to the rules contained herein, be permitted to open another Free Play Account.
4.1. You hereby declare and warrant that:
4.1.1. You are over 18 years of age or such higher minimum legal age of majority as stipulated if the jurisdiction of Your residence and, under the laws applicable to You, legally allowed to participate in the Games offered on the Websites.
4.1.2. You participate in the Games strictly in your personal non-professional capacity for recreational and entertainment reasons only;
4.1.3. You participate in the Games on your own behalf and not on behalf of any other person;
4.1.4. All information that You provide to Gnuf during the term of validity of this agreement is true, complete, and correct, and that You shall immediately notify Gnuf of any change of such information;
4.1.5. The use, in any manner whatsoever, of artificial intelligence including without limitation, “robots” is strictly forbidden when participating in any of the Games on the Websites. All participation in the Games on the websites must be executed by You personally through the use interface made available by Us on the Websites. You agree that Gnuf may take steps to detect and prevent the use of prohibited EPA Programs. These steps may include, but are not limited to, examination of software programs running concurrently with the Gnuf computer software on Your computer.
4.1.6. In the event that We deem You have been involved in any fraudulent, improper, collusive, fixing or other unlawful activity in relation to Yours or any third parties’ participation in any of the Games on any of the Websites including without limitation, use of a prohibited EPA Program, use of any software-assisted methods or techniques or hardware devices for Your participation in any of the Games, or that You have colluded or attempted to collude with another user of the Websites, We shall be entitled to take such action as We see fit, including without limitation, immediately blocking Yours and any relevant third parties from accessing the Websites.
4.1.7. The computer software that we make available to you is owned by Microgaming and/or other licensors and is protected by copyright laws. You may only use the software for your own personal, recreational uses in accordance with all rules, terms and conditions we have established and in accordance with all applicable laws, rules and regulations. You hereby agree to abide by the terms of use contained within the End User Licence Agreement.
4.1.8. Games played on Our site should be played in the same manner as games played in any other setting. This means that players should be courteous to each other and avoid rude or obscene comments.
5.1. You hereby acknowledge and accept that its is necessary for Gnuf to collect and otherwise store Your personal data in order to allow You access and use of the Website and in order to allow You to participate in Games. You hereby acknowledge and accept that all telephone calls made by you to Gnuf shall be recorded for Your own protection and benefit.
5.2. The Company hereby acknowledges that in collecting Your personal details as stated in the previous provision, We are bound by the Data Protection Act, Chapter 440 of the Laws of Malta. The Company will protect your personal information and respect your privacy in accordance with best business practices and applicable laws.
5.3. Gnuf will only use Your personal data to allow you to participate in the Games and to carry out operations relevant to Your participation in the Games.
5.4. Your personal data will not be disclosed to third parties, unless such disclosure is necessary for processing of your requests in relation to Your participation in the Games or unless it is required by law. You hereby consent to such disclosures.
5.5. You have the right to access personal data held by Gnuf about You.
5.6. In order to provide You with an efficient service, Gnuf and/or its service providers may require transferring your personal data from one country to another. You hereby consent to Your personal data being transferred in this manner.
5.7. In order to make Your visit to the Websites more user-friendly, to keep track of visits to the Websites and to improve the service, Gnuf collects a small piece of information sent from Your browser, called a cookie. You can, if you wish, turn off the collection of cookies (please refer to your browser instructions as to how to do this). You must note, however, that turning off cookies may restrict Your use of the Websites.
5.8. We may also inform you of changes, new services and promotions We think that You may find interesting. If you do not wish to receive direct marketing data you may opt out of such service (please refer to your browser instructions as to how to do this).
6.1. We hereby grant you a revocable, non-exclusive, non-transferable right to use the Websites and the Software and all content derived from the Websites and the Software, including copyright and all intellectual property rights therein, in connection with the Websites and Games in accordance with these T&Cs.
6.2. You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all material or content supplied as part of the Websites and the Software shall remain at all times vested in us or our licensors. You are permitted to use this material only as expressly authorized by us or our licensors.
6.3. You acknowledge and agree that the material and content contained within the Websites is made available for your personal non-commercial use only and that you may download such material and content onto only one computer hard drive for such purpose. Any other use of such material and content is strictly prohibited. You agree not to (and agree not to assist or facilitate any third party to) copy, reproduce, transmit, publish, display, distribute, commercially exploit, tamper with, or create derivative works of such material and content.
7.1. The Websites are designed for amusement purposes and for personal use. If you have ever been diagnosed with any form of compulsive gambling disorder, you are prohibited from participating in any free play games at the Websites. 8.3. If for some reason you are not satisfied with the resolution of your complaint by Gnuf, you can complaint to the Malta Lotteries and Gaming Authority at www.lga.org.mt.
9.1. The Website and the computer software are provided "as is". We make no warranty or representation, whether express or implied, in relation to the satisfactory quality, fitness for purpose, completeness or accuracy of the Website or the computer software.
9.2. We shall not be liable for computer malfunctions, failure of telecommunications service or Internet connections nor attempts by you to participate in games by methods, means or ways not intended by us.
9.3. We cannot guarantee that the Service will never be faulty but we will correct reported faults as soon as we reasonably can. If a fault occurs you should report the fault by e-mail or in writing to Customer Support.
9.4. Although we shall take all reasonable measures to ensure that the computer software and files are free from computer viruses we cannot and do not guarantee that the computer software and files are free of such problems. It is your responsibility to protect your systems and have in place the ability to reinstall any data or programs lost due to a virus.
9.5. We may temporarily suspend the whole or any part of the Website for any reason at our sole discretion. We may, but shall not be obliged to, give you as much notice as is reasonably practicable of such suspension. We will restore the Website, as soon as is reasonably practicable, after temporary suspension.
9.6. In the event of a Website system malfunction all Games are void.
9.7. In accordance with clause 10 below, we will not be liable to you for any loss that you may incur as a result of such suspension or delay.
10.1 You indemnify and hold harmless Gnuf, its directors, officers, employees, shareholders, agents and affiliates, the ultimate parent and parent companies of Gnuf and any of its subsidiaries against any and all costs, expenses, liabilities and damages (whether direct, indirect, special, consequential, exemplary or punitive or other) arising from any participation by you at the Websites. The nature of your participation shall include, but not be limited to:
10.1.1. visiting, use or re-use of the Websites;
10.1.2. use or re-use of any materials at, or obtained from, the Websites of any other source whatsoever;
10.1.3. entry, use or re-use of the Websites servers;
10.1.4. use of your Free Play Account;
10.1.5. playing the Games available on the Websites;
10.1.6. acceptance and use of any prize offered by the Websites;
10.1.7. use of re-use of the computer software, whether downloaded from the Websites or by any other means of through any other medium
10.2 In no circumstances whatsoever shall Gnuf, its directors, officers, employees, shareholders, agents and affiliates, the ultimate parent and parent companies of Gnuf and any of its subsidiaries be liable to you in contract, tort, negligence or otherwise, for any loss of damage howsoever arising from any cause whatsoever, whether direct or indirect, or for any amounts whatsoever (even where we have been notified by you of the possibility of such loss or damage).
11.1. We may refuse to register You as a Player or elect to deregister and exclude you or suspend you as a Player from any or all of the Websites at any time and for any reason whatsoever.
11.2. You acknowledge hereby that Gnuf is not obliged to give you prior notice of its decision to refuse, deregister or exclude or suspend you, nor to furnish you with any reasons for such decision.
11.3.1. solely determine what criteria you shall have to meet in order to establish a new Free Play Account with Gnuf; and/or
11.3.2. in the case of fraudulent, illegal or similar misconduct by you:
11.3.3.1. furnish any relevant information about You to an intra-group database recording such mischief and, You hereby irrevocably authorize us to do so in our absolute discretion, and/or
11.3.3.2. have forfeited to us any contested prizes that may be derived by you from fraudulent, illegal or similar misconduct.
12.1. The Company’s employees, subsidiaries and affiliates connected to any referral programs linked to the Company, advertising or other agencies, licensees, licensors, distributors and their other associated or affiliated companies or, in the case of individuals, the immediate family of such individuals, are not eligible to participate in the Games on the Websites.
13.1. No indulgence granted by the Company to you should be construed as a waiver of any of the Company’s rights in terms of these T&Cs.
14.1. Unless otherwise expressly stated, nothing in these T&Cs shall create or confer any rights on any persons not party to these T&Cs.
15.1. If any provision of these T&Cs is held to be illegal or unenforceable, such provision shall be severed from these T&Cs and all other provisions shall remain in force unaffected by such severance.
16.1. Gnuf reserves the right to assign or otherwise lawfully transfer this Agreement. You shall not assign or otherwise transfer this Agreement.
17.1. Unless the context otherwise indicates, these T&Cs set out the entire agreement between us and supersede all prior oral or written agreements, arrangements or understandings between us. You acknowledge that you are not relying on any representation, agreement, term or a condition that is not set out in this Agreement.
18.1. These T&Cs are governed by the Laws of Malta and the parties submit to the jurisdiction of the Maltese courts.
